Early Access Terms

These terms apply to participation in the MyVitalAssistant early access program operated by Vital Consulting ("we", "us"). They supplement our Terms of Service and Privacy Policy; where they conflict, these Early Access Terms control for early access participants.

What early access is

MyVitalAssistant is under active development. Early access means you are using pre-release software that is incomplete, will change, and may contain errors. Features may be added, altered, or removed without notice, and the service may be interrupted or unavailable at times.

Access you grant us

To provide the service, you authorize us to connect to and read data from accounts you designate, such as your Keap application, your Google Ads and Meta ad accounts, and your call tracking platform. This includes live spend, lead, contact, and revenue data. You confirm you have the authority to grant this access. We use it only to provide and improve the service for you, as described in our Privacy Policy. You may revoke access to any connected account at any time.

What we ask of you

Participation includes a short feedback conversation on a roughly weekly basis, reasonable responsiveness on setup questions, and your candid input on the product, including what it should cost. If participation stops working for you, telling us so is enough. Either of us may end participation at any time.

Feedback

You grant us a perpetual, irrevocable, royalty-free license to use suggestions, ideas, and feedback you provide, without obligation or compensation. Anything you tell us about pricing is input to our decisions, not an offer, quote, or commitment by either side.

Fees

Early access is provided at no charge. We will tell you before any paid plan applies to you, and continuing past that point is your choice.

Confidentiality

We will not disclose your business data to anyone outside Vital Consulting except as needed to operate the service (such as the infrastructure providers listed in our Privacy Policy). You agree not to publicly share non-public details of the product without our consent. Aggregated or anonymized results that do not identify your business may be used to improve and describe the service.

Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Attribution figures produced during early access are estimates from evolving software and available data; they should inform your judgment, not replace it.

Limitation of liability

To the maximum extent permitted by law, Vital Consulting will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunity, arising from or related to the early access program, including business or advertising decisions made using the service. Our total aggregate liability for any claim arising from the program will not exceed one hundred US dollars ($100).

Term and ending participation

Either party may end participation at any time, for any reason, with notice to the other. On ending, we will disconnect your accounts, and on request delete data we hold for you, as described in the Privacy Policy.
